These Terms of Service ("Terms") govern your use of MaintainHQ, operated by MaintainHQ Ltd. ("we", "us"). By creating an account or using the service, you agree to these Terms.

Service description

MaintainHQ provides a cloud platform for WordPress site monitoring, maintenance automation, backups, security scanning, reporting, and AI-assisted workflows. Features vary by subscription plan.

Accounts

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account and for ensuring you have permission to connect client sites.

Subscriptions and billing

Plans are billed monthly unless otherwise stated.
Free trials require a valid payment method; billing starts after the trial period unless cancelled.
Prices may change with reasonable notice; existing subscribers are notified before changes apply.
Refunds are handled case-by-case in line with applicable consumer law.

Acceptable use

You agree not to:

Use the service for unlawful purposes or to harm third parties
Attempt to bypass security, scrape the platform abusively, or interfere with other users
Connect sites you do not own or lack authorisation to manage
Resell the service without a written agreement

Client sites and backups

MaintainHQ connects to your WordPress sites via a connector plugin. You remain responsible for your sites, hosting, and compliance with client contracts. While we provide backup tools, you should maintain independent backups for business-critical sites.

AI features (Otto)

Otto provides suggestions and automation based on site data. AI outputs may be inaccurate. You must review actions before applying changes to production sites. We are not liable for damage caused by following AI recommendations without verification.

Intellectual property

MaintainHQ, Otto, and related branding remain our property. You retain ownership of your site content and data. You grant us a limited licence to process site data solely to provide the service.

Availability

We aim for high availability but do not guarantee uninterrupted service. Agency plans may include SLA terms as specified in your agreement.

Limitation of liability

To the maximum extent permitted by law, MaintainHQ is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or business. Our total liability for any claim is limited to fees paid in the 12 months before the claim.

Termination

You may cancel anytime from billing settings. We may suspend or terminate accounts that violate these Terms. On termination, your access ends and data is handled per our Privacy Policy.

Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence.
